1. Contents as present as said

MyKapot is not responsible for verifying the description and content of the consignment posted on the list/invoice/App data by the sender, so the customer must confirm and provide that details filled are correct and in the manifest. However, MyKapot reserves the right to inspect and/or refuse to receive consignments that do not comply with these instructions and conditions, only after notifying the sender of the reason for the review and/or rejection and approval by the supplier. Customer must not post or post any consignment containing prohibited, restricted or any dangerous goods.

The Customer shall indemnify MyKapot, its directors and employees against all claims, losses, costs and expenses if incurred any.

2. Prohibited Items

MyKapot will not take any responsibility or liability of any Prohibited items.

3. Limitation of Liability

  • In the event that a pre-booked consignment is lost, stolen, damaged, or improperly handled, MyKapot's maximum liability shall not exceed Rs. 100/- only for documents.
  • Responsibility of MyKapot ends, Once the consumer receives the receipt physically, virtually, or through an application.

4. Area Boundaries

If letters unknowingly reserved an area with NSA (Non-Service Zone), eg. via the MyKapot network, in this case the above items must be returned to the party/sender. MyKapot 's maximum liability for NSA services is limited to return shipping cost.

5. Transportation Mode

MyKapot has the right to employ any transportation method and path.

COOKIES

Non-personal information is data in a form that does not permit direct association with any specific individual, such as your Android ID, CPN model, memory size, your phone IMEI number, phone model, rom, phone operator, location, install, uninstall, frequency of use, etc. We may collect and use non-personal information in the following circumstances. To have a better understanding in user’s behavior, solve problems in products and services, improve our products, services and advertising, we may collect non-personal information such as the data of install, frequency of use, country, equipment and channel. If non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

6. Contract

The data on app and other online portal is a legal agreement between the consumer and MyKapot.

7. Acceptance of T&Cs

By offering your consignment to us, you are agreeing to the terms and conditions stated on the app of MyKapot, on behalf of yourself and/or other persons dealing with the goods or other services. Whether or not you sign our delivery form will affect the delivery or provision of other services. Our terms and conditions also apply to and may be used by persons we use or subcontract to collect, transport, deliver your goods or perform other services, including employees, managers and agents. Only one of our authorized officers can accept changes to these terms and conditions in writing. Where you give verbal or written instructions that are inconsistent with our terms and conditions, we will not be bound by the instructions.

8. Law and Jurisdiction

All disputes and claims shall be subject to the exclusive and final jurisdiction of the courts located in Surat, and no other court shall have jurisdiction. This contract shall be governed by and construed in accordance with the laws of India.

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory. This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

9. Documentations

  • According to legislative requirements, the customer is required to provide complete and accurate documentation, as well as accurate information about the customer's and recipient's names, addresses, phone numbers, email addresses, and other forms, waybills, invoices, etc.
  • If any documentation or legal requirements are missing, MyKapot will not be held responsible or liable, and no claim or complaint of any kind will be considered.
  • Customer hereby agrees to make good any loss to MyKapot in the event that their consignment(s) damage other consignment(s) loaded in the vehicle due to inherent nature and which is wrongly declared by the customer OR in the event that other consignment(s) are delayed as a result of a government authority seizing them due to improper and incomplete documentation.
  • MyKapot is not responsible for any form of product damage brought on by inadequate or flawed packaging.

10. Entrusting authority

The MyKapot retains the right to use any other carrier to transport the products. Due to circumstances beyond our control, such as those brought on by natural disasters or man-made disasters, the MyKapot will not be held responsible for any delay, damage, or loss during its transit through another carrier.

11. Lien

In order to collect any debts owed to MyKapot by the client, MyKapot shall have a general lien over all of the customer's consignments.

12. Claims

  • No claim for any loss, shortfall, damage, non-delivery, breakage, leakages, pilferage, etc. of the consignment will be accepted by the MyKapot unless a written claim is filed within 30 days of the booking date, subject to comments on the proof of delivery.

13. Payment Weight

  • Every consignment must be charged based on its chargeable weight, which is the greater of the actual weight or volumetric weight.

14. Expulsion

  • Even if we knew that some damages or losses might occur inspite of proper care and precautions, we won't be held responsible for them. Neither will we be held responsible for indirect, incidental, special, or consequential damages or losses of any kind, including without limitation those brought on by contract violations, negligence, willful misconduct, or default.
  • In the event that we fail to perform any of our duties to you due to reasons outside of our control, such as (but not limited to):
    a) Natural calamities or disasters caused by acts of God, such as earthquakes, cyclones, storms, flooding, fire, illness, fog, snow, or ice.
    b) War, accidents, public enemy acts, strikes, embargoes, hazard, local disputes or civil commotions, among other things, are examples of force majeure.

15. Address Modification

If the sender modifies the address or makes any other changes after booking a consignment, additional fees will be assessed as a result of the modification, as determined by the firm.

16. Special contract terms

The outlined terms and conditions are in addition to any other agreements made between MyKapot and the customer.

17. Arbitration

Any disagreement or difference arising from or related to this contract will be resolved by a single arbitrator chosen by MyKapot, in accordance with the current provisions of the Arbitration and Conciliation Act, 1996, and any updates thereto. The arbitration shall only take place in Surat jurisdiction and shall be conducted in the English/Gujarati language. The arbitrator's decision is final and enforceable against both parties.

18. Right to Change

MyKapot retains the right to modify the terms and conditions without providing previous notification.

19. Non cashback coupons

Offer valid for stipulated time period only.
This offer cannot be combined with any other promotion.
MyKapot maintains the right, at any time and without notice, to cancel/change/modify/add/delete any of the terms and conditions of the offer.
MyKapot retains the right to discontinue the offer at any time and without notice.
